This Privacy Policy explains how personal data is handled when you visit https://morphy.vision/ (the “website”) or contact us through it. It covers our marketing website and enquiries you send us.

This policy does not cover our virtual try-on product that is embedded on eyewear retailers’ websites — that has its own Virtual Try-On Privacy Notice.

Who we are (data controller)

The website is operated by Olena Gertsuska, an individual entrepreneur (empresário em nome individual / independent worker) established in Portugal, with tax identification number (NIF) 318064839, trading as “Morphy Vision” (“we”, “us”, “our”). “Morphy Vision” is a business name; the data controller is the named individual.

Information we collect

We only collect personal data that you provide or that is technically necessary to run the website:

  • When you contact us (contact form or email): your name, email address, phone number, company name, and the contents of your message and any attachments. We use this only to respond to and follow up on your enquiry.
  • When you book a call with us (via our scheduling provider): your name, email address, and the meeting details you provide.
  • Technical data (server logs): when you visit the site, our hosting provider automatically logs standard technical information such as your IP address, browser type and version, device/operating-system information, date and time, and the pages requested. Under EU law, an IP address is personal data. We use this only to operate, secure and troubleshoot the website.

We do not operate user accounts, we do not sell your personal data, and we do not use it for automated decision-making that produces legal or similarly significant effects.

How we use your information, and our legal bases

We process the data above for the following purposes and legal bases under the GDPR:

  • Responding to your enquiries and providing our services — on the basis of taking steps at your request prior to, or performing, a contract (Art. 6(1)(b)), and our legitimate interest in answering business enquiries (Art. 6(1)(f)).
  • Operating, securing and maintaining the website and preventing fraud or abuse — our legitimate interests (Art. 6(1)(f)).
  • Sending you marketing or updates, where we do so — only with your consent (Art. 6(1)(a)), which you can withdraw at any time (e.g. via the unsubscribe link).
  • Complying with legal obligations — Art. 6(1)(c).

Cookies

Our website uses only the cookies strictly necessary for it to function properly. Where we use any non-essential cookies (for example, analytics), we request your consent through a cookie banner before they are set, and you can withdraw or change your choice at any time. You can also block or delete cookies through your browser settings.

Who we share information with

We do not sell or rent your personal data. We share it only with service providers who process it on our behalf, under appropriate data-protection terms, including:

  • our website hosting provider (server logs and website delivery);
  • our email provider (to receive and reply to your messages);
  • our scheduling provider (e.g. Calendly, when you book a call).

We may also disclose information where required by law, or to protect our rights, safety and security.

International data transfers

Some of our service providers may be located outside the European Economic Area (for example, in the United States). Where personal data is transferred outside the EEA, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses and/or an adequacy decision or certification, as applicable. You may request details of these safeguards using the contact details above.

How long we keep your information

We keep enquiry and contact data only for as long as needed to deal with your request and for a reasonable period afterwards for our records and legal purposes, then delete it. Server logs are kept by our hosting provider for a limited period for security and reliability. We do not keep personal data longer than necessary.

Your data protection rights (GDPR)

If you are in the EEA, the UK or a comparable jurisdiction, you have the right to:

  • Access — request copies of your personal data;
  • Rectification — have inaccurate or incomplete data corrected;
  • Erasure — have your data deleted, in certain circumstances;
  • Restriction — restrict our processing, in certain circumstances;
  • Objection — object to processing based on legitimate interests, and to direct marketing at any time;
  • Data portability — receive your data in a portable format;
  • Withdraw consent — at any time, where processing is based on consent.

To exercise any of these rights, contact us at privacy@morphy.vision. We will respond within one month, as required by law. You also have the right to lodge a complaint with your local data protection authority; in Portugal this is the CNPD (www.cnpd.pt).

California privacy rights (CCPA/CPRA)

To the extent the CCPA/CPRA applies to us, California residents have the right to know, access, delete and correct their personal information, and to opt out of its sale or sharing. We do not sell or share personal information as those terms are defined under California law. To exercise these rights, contact us at privacy@morphy.vision.

Children’s information

Our website is not directed to children and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us at privacy@morphy.vision and we will delete it.

Changes to this policy

We may update this Privacy Policy from time to time. We will revise the “Last updated” date above when we do, and, for material changes, provide a more prominent notice where appropriate.
